In this paper we aim to examine a novel view on distributive justice, i.e. limitarianism, which claims that it is morally impermissible to be rich. Our main goal is to assess the two arguments provided by Ingrid Robeyns in favour of limitarianism, namely the democratic argument and the argument from unmet urgent needs and the two distinct limitarian views which these arguments give rise to. We claim that strong limitarianism, which is supported by the democratic argument, should be rejected as (...) it fails to fully instantiate the value of political equality, while having some other unattractive implications as well. By contrast, we argue that weak limitarianism, which is supported by the argument from unmet urgent needs, should be endorsed, albeit in a qualified version which also takes responsibility constraints into consideration. Many important criticisms to the possibility of global justice are advanced following one or another operationalization of the Rawlsian concept of a basic structure. The purpose of this paper is twofold: i) to show that the existence of a global basic structure is irrelevant from the standpoint of justice; ii) to set the stage for a cosmopolitan theory of global justice that employs satisficing sufficientarianism as a distributive principle. One of the main contentions is that the institutional-interactional cut in the (...) recent literature should be transcended. That is, the site of justice should be extended to incorporate both the efficiency of discharging one’s duties through a just institutional scheme and the moral value of promoting a good state of affairs through one’s own efforts. In order to avoid the overdemandingness objection, however, the selected principles of justice ought to belong to the sufficientarian family. Towards the end of the paper I sketch one such theory, satisficing sufficientarianism. (shrink)

In this paper I make a contribution to three distinct, but deeply interwoven subjects. Firstly, I argue that, at the level of ideal theory, the distribution of educational goods should follow a sufficientarian pattern and that the evaluative space of children’s advantage should be inspired by the capability approach. Secondly, the paper is delving into the more policy-oriented debates on the desirability of school choice. I argue that, given the non-ideal circumstances in which decision makers have to act, giving parents (...) the opportunity to choose the school for their children is a sine qua non condition for even approaching the ideals of sufficientarian justice. Lastly, I move the discussion on more empirical grounds, advancing a criticism of the Romanian educational legislation. I argue that the sufficiency-constrained school choice system that I envision could solve some of the problems that the Romanian educational system faces today. (shrink)

Unlike other kinds of theories of justice, reparatory justice can only be negatively defined, in non-ideal contexts in which initial wrongs had already been committed. For one, what counts and what does not count as wrongdoing or as an unjust state of affairs resulted from that wrongdoing depends on the normative framework upon which a theorist relies. Furthermore, the measures undertaken for alleviating historical injustices can be assessed only from the vantage point of other, independent normative considerations. In the present (...) paper I argue that this lack of substance is a feature that, far from being problematic, is what makes reparatory justice attractive. The specific example that I put forward is that of a reparatory justice account which seeks to instantiate the desiderata of a sufficientarian theory of justice. At first, distributive justice fills the content of reparatory justice, specifying up to what level reparations in-kind or compensatory measure should go. Afterwards, reparatory justice clarifies and provides epistemic inputs for distributive justice. Reparatory justice thus becomes an epistemic source for distributive justice, in that it provides the means for assessing whether someone’s level of well-being can be traced to her choice or to a wider, historically-sensitive operationalization of her “circumstances”. Are intellectual property rights for talented people justified by Rawls’ criteria of justice? In this paper, I argue that Rawls’ theory of justice is ill-equipped to answer this question. Tailored for rival goods and, as a result, centred on the distribution of benefits, it tends to restate questions of justice about unequal rights as questions about economic inequalities. Therefore, it lacks the tools necessary to distinguish among different forms of incentives for talented people. Once social and economic inequalities observe equality (...) of opportunity and improve the least advantaged, the theory is indifferent as to whether talented people are allowed to compete for monopoly rights or for direct financial reward. In the present chapter I try to determine to what extent the public policies adopted by Romanian governments following the fall of the communist regime contributed to alleviating the most egregious past injustice, the Holocaust. The measures taken for memorializing the Holocaust will be analysed through the lens of a mixed reparatory justice – relational egalitarian account. Employing such a framework entails a focus on symbolic reparations, meant to promote civic trust, social solidarity, and encourage the restoration of social and (...) cultural capital in societies affected by historical injustices. Such symbolic reparations can include public atonement, changing street names, establishing memorials, funding museums, including Holocaust study in the national curriculum, setting national days for the commemoration of the Holocaust, etc. The need for symbolic reparation has become increasingly clearer in the literature on Holocaust memorialization, and the present paper intends to go a step further, by providing researchers with a theoretical approach that can be used to make better sense of the effects of measures taken as part of the process of Holocaust remembrance. In the chapter I also address the issue of determining who the duty-bearers should be. I argue that there could be several indicators for reparatory justice, including in this case compensation programs and the establishment of institutions that would allow dialogue between descendants of the victims and descendants of the perpetrators, a sine qua non condition for restoring social trust in communities marked by violations of human rights, especially of such a scale as the Holocaust. In this article I defend the capability approach by focusing on its built-in gender-sensitivity and on its concern with comprehensive outcomes and informationally-rich evaluation of well-being, two elements of Sen's work that are too rarely put together. I then try to show what the capability approach would have to gain by focusing on trans-positional objectivity (as Elizabeth Anderson does) and by leaving behind the narrow confines of states in favor of a more cosmopolitan stance. These preliminary discussions are followed by (...) two more precise applications. At first, I show how a gender-sensitive capability approach that respects the criteria of trans-positional objectivity and cosmopolitanism can enhance the agency of women inhabiting third-world societies. I turn next to show how mainstream feminism can insulate itself against criticisms such as bell hooks' by switching to trans-positional objectivity in public reasoning. (shrink)

This paper argues that by overestimating the importance of citizenship rights, the ethics of immigration turns away from the more serious problem of closed borders. Precisely, this contribution is a threefold critique of Carens’ idea that "justice requires that democratic states grant citizenship at birth to the descendants of settled immigrants" (Carens, 2013: 20). Firstly, I argue that by making 'justice' dependent on states and their attributes (birthright citizenship), this idea strengthens methodological nationalism which views humanity as naturally divided into (...) bounded nation-states. Secondly, I analyze its justification and argue that grounding (citizenship) rights on the existence of social connections is logically and morally problematic. Thirdly, I analyze its scope (granting rights to the descendants of the ‘settled’) and its method of implementation (granting citizenship rights automatically ‘at birth’). While from a less sedentarist perspective, no one can be considered ‘settled’ in advance, I will express some doubts that granting citizenship rights is always automatically a way to extend people’s rights. All in all, I argue that by its justification, scope and method of implementation, this idea moves us away from, rather than gets us closer to, an open-borders world. (shrink)

It is often argued that development aid can and should compensate the restrictions on migration. Such compensation, Shachar has recently argued, should be levied as a tax on citizenship to further the global equality of opportunity. Since citizenship is essentially a ‘birthright lottery’, that is, a way of legalizing privileges obtained by birth, it would be fair to compensate the resulting gap in opportunities available to children born in rich versus poor countries by a ‘birthright privilege levy’. This article sets (...) out a defence of three theses. The first states that equality of opportunity is incompatible with, and cannot be achieved in, segregated territories. The second posits that to believe that material equality compensates the injustice of restrictions on movement is to commit a ‘sedentarist mistake’. The third affirms that any citizenship levy, including the egalitarian and non-sedentarist formula I’m proposing, would be better understood as a penalty rather than a tax. (shrink)

Brain drain critiques and human rights advocates have conflicting views on emigration. From a brain drain perspective, the emigration harms a country when emigrants are skilled and the source country is poor. From the human rights perspective, the right "to leave any country, including one's own" is a fundamental right, protected for all, whatever their skills. Is the concern with poverty and social justice at odds with the right to emigrate? At the beginning of the l970s, the economist Jagdish Bhagwati (...) replied in the negative. He imagined a tax on the income earned by the skilled migrants in the destination country, to the benefit of the source country. He thus sought to reconcile the right to emigration and the brain drain effects. -/- This article argues that there is no need to tax skilled migrants in order to reconcile the right to emigration and social justice. Social justice is not incompatible with the right to emigration but rather with restrictions on mobility. If it is both the case that equal opportunities are a minimal requisite for social justice, and that access to opportunities implies freedom of movement, as I shall argue, then the brain drain criticism doesn't satisfy the minimal requirements of social justice. -/- The article is divided into three parts. Each part rejects one of the possible justifications of the Bhagwati tax, that is, as a way, for skilled migrants, (i.) to compensate the welfare loss occasioned to their country of origin; (ii.) to discharge for their obligation to the national community when it publicly financed their education; and (iii.) to compensate for the resulting inequality of opportunities between themselves and their non-migrant compatriots. When it comes to specifying the moral duties we bear towards future generations, most political philosophers position themselves on what could be regarded as a safe ground. A variant of the Lockean proviso is commonplace in the literature on intergenerational justice, taking the form of an obligation to bestow upon future people a minimum of goods necessary for reaching a certain threshold of well-being (Meyer, 2017). Furthermore, even this minimum is often frowned upon, given the non-identity problem and the challenges (...) this presents to the topic of justice between generations. Additional issues are raised at the level of non-ideal theory, the most significant being the problem of non-compliance (Gosseries and Meyer, 2009).In this paper I intend to probe the limits of “practical political possibility” (Rawls 1999), by inquiring whether embracing the sufficiency view (Frankfurt, 1987; Crisp, 2003; Benbaji, 2005) as a distributive pattern and capabilities as a metric can lead to more burdensome obligations for present generations. More specifically, I try to show that we have a duty to invest in research that aims at prolonging the lifespan of humans (the idea can already be found in the sufficientarian literature, for instance in Farrelly, 2007). Moreover, given the Earth’s limited resources, we ought to encourage the terraforming of other planets in order to make them inhabitable for (future) people.I argue that these two seemingly far-fetched projects are in fact worthwhile goals to pursue on the one hand, and moral obligations on the other hand. Nonetheless, they are not the only ones we ought to take on; for instance, we must simultaneously pursue them and try to improve the prospects of those who fall under a sufficiency threshold here and now. That is, specifying these (prima facie) duties towards future generations is connected with stronger obligations towards the current generation.Towards the end of the paper I engage in a discussion regarding the role of the feasibility constraint in a theory of justice, as rationales pertaining to feasibility are perhaps going to be the most recurrent criticisms raised against my proposal. To that end, I defend limitarian policies, which aim at setting an upper limit to how much money individuals are allowed to possess (Robeyns, 2017; Volacu and Dumitru, 2019). (shrink)

Both of them fare extremely well in regard to either a case-implication critique or a prior-principle strategy of argumentation (with the former requiring us to check the implications of a principle in counterfactual cases, and the latter testing the compatibility of a principle with certain more (...) fundamental values, according to Sen [197]). How are we to decide between them? To the extent that we believe that one of the purposes of political philosophy is to issue achievable and desirable recommendations (Stemplowska 319) or to be action-guiding (Swift 363), we might compare the two by applying a feasibility criterion. Such a criterion indicates that a state of affairs could be realized “if we were to summon sufficient practical will and direct our (individual or collective) efforts in the right direction” (Gheaus 450). In our case, the decision is a relatively easy one: both theories pass a threshold of acceptability and thus we would be morally justified in attempting to bring them about. Furthermore, by stipulation, world A in which theory x were implemented would be equally desirable as world B, in which theory y were implemented. The only distinction would be one concerning their feasibility.Nonetheless, this scenario is usually not one that is available to us. If theories differ based on their desirability as well as their feasibility, how are we to choose? One option would be to choose that moral theory which best satisfies the criteria mentioned by Buchanan, of moral accessibility, feasibility, and accessibility (Justice, Legitimacy). The argument is that, in the specific context of intergenerational justice, we ought to pay more attention to the matter of social capital extant in a society, if we want to achieve the ends of an intergenerational theory of justice. The concept of social capital puts under the same umbrella distinct features of social life such as networks and civic engagement, the role of reciprocity and trust in building institutions, and the effects that informal rules and institutions have on formal ones (Ostrom and Ahn, “Social Science Perspective” 4). Intuitively, these aspects are relevant for an account of intergenerational justice. The particular way in which they are relevant will be detailed later in this article.The claim that I defend is that the higher the level of social capital in a community, the more probable it will be that individuals are willing to redistribute resources to future generations. In this paper, I argue that universities ought to account for the diverse conceptions of the good employed by their students. The complex nature of the good of education, which has both instrumental and intrinsic aspects, means that the modern university should be impartial between students who consume this good for itself or as a means towards more fulfilling goals. The discussion on the intrinsic nature of education follows the line of the Humboldtian perspective. The instrumental benefits considered are the (...) better democratic outcomes reached by having an educated population, the autonomy-facilitating character of higher education and the improvement of marketable skills. I put forward the view that achieving a balance between satisfying the needs of students valuing education intrinsically and those of students valuing it instrumentally is a strategy that should be employed by universities if they aim at regaining their imperiled legitimacy. In this paper I examine some presuppositions of toleration and pluralism. I explore two models, viz. a deontological and a consequentialist model, respectively, which could support the view that rational agents should act in a tolerant way. Against the background which is offered by the first model I give two arguments in favor of the view that people are better off and more rational if they act in a tolerant way. The first argument draws upon a principle of charity which (...) one usually makes use of in philosophy of mind and philosophy of language but which could work equally well with regard to this foundational issue in ethics and philosophyof action. The second argument is built upon the epistemic principle of fallibilism and it is meant to show that from this vantage point acting in a tolerant way is the rational thing to do. (shrink)

Explaining phenomenal consciousness may be the scientific and philosophical problem of our time, the last frontier of knowledge. This is not at all an easy task. For any serious attempt at finding a place for consciousness within the natural world was not successful so far. There is a conceptual tension here which makes this business of coming up with a unified (monist) explanation of mind and physical world one of the most intriguing mystery. The most predominant image of the natural (...) world is one of a physicalist type, whereas the mind, and especially the conscious subjective experience seem not to fit well within that physicalistexplanation. That explanatory failure may require a dualist metaphysical scheme (probably of a neo-Cartesian type). It may seem very well that we are caught in a dilemma, for we either embrace a physicalist explanation, but then it seems that we leave out consciousness from the big picture we are looking for, or else we face the huge task of conceiving a dramatic change of our scientific outlook about the natural world, and we don’t quite see how that would be possible or desirable. But then, should any attempt at understanding consciusness be a dead-end, something doomed to fail from a theoretical and explanatory point of view? In my paper I explore some philosophical underpinnings of contemporary dualism, focussing on the modal facets of the conceivability (neo-Cartesian) arguments. I will asses both the prospects and the moot points of this type of arguments. Of particular interest is the role that two-dimensional semantics plays in nowadays discussions of this topic. (shrink)

Centuries II and III of Francis Bacon’s posthumous natural history Sylva Sylvarum are largely dedicated to sound. This paper claims that Bacon’s investigation on this topic is fruitfully read against the background of the Aristotelian theory of sound, as presented in De anima commentaries. I argue that Bacon agreed with the general lines of this tradition in a crucial aspect: he rejected the reduction of sound to local motion. Many of the experimental instances and more theoretical remarks from his natural (...) history of sound can be elucidated against this wider concern of distinguishing sound from motion, a theme that had been a staple of Aristotelian discussions of sound and hearing since the Middle Ages. Bacon admits that local motion is part of the efficient cause of sound, but he denies that it is its form, which means that sound cannot be reduced to a type of local motion. This position places him outside subsequent developments in natural philosophy in the seventeenth century. (shrink)

The general slogan in the title of this paper gives a general, but nevertheless accurate, expression of Strawson’s view concerning the nature of formal logic per se in relation to natural language. What is at stake here is the extent to which the formal methods and the formal semantics of contemporary symbolic logic can render the meanings of natural language expressions. Strawson sets up an agenda for logical theory which, although rather dated for a logic text, is what one naturally (...) expects from an introduction to elementary formal logic and a systematic analysis of certain crucial metalogical concepts, most notably entailment. However, my own reading is that Strawson’s approach to logic makes a lasting contribution to understanding the inner workings of natural language through his critical discussion of the limits of the formal renderings of the semantics of natural language expressions via canonical first-order notations. One can recognize in this critical attitude towards the limits of formal methods a consistent generalization of Strawson’s own strategy from his critical response to Russell’s theory of descriptions.In my paper I shall focus on certain examples which illustrate the general slogan that characterizes Strawson’s views on the nature of logic in connection with ordinary language and talk. The dissertation gives a second-order-logic-based explanation of modal incompleteness. The leading concept is that modal incompleteness is to be explained in terms of the incompleteness of standard second-order logic, since modal language is basically a second-order language. The development of Kripke-style semantics for modal logic has been underpinned by the conjecture that all modal systems are characterizable by classes of frames defined by first-order conditions on a binary relation. However, the discovery of certain incomplete modal systems has undermined the all-encompassing (...) feature of Kripke-style approach. There are logics not determined by any class of Kripke frames at all. ;In the dissertation I investigate a normal incomplete sentential modal system due to J. F. A. K. Van Benthem, and I address both the formal and the philosophical facets of modal incompleteness from the vantage point that modal logic is essentially second-order in its nature. Modal systems can be analyzed in terms of structures with a domain of second-order individuals that are assigned under an interpretation to propositional variables within languages of sentential modal logic. Hence, the phenomenon of there being incomplete modal systems can be accounted for through the incompleteness of standard second-order logic. ;Since second-order logic plays a crucial role in the explanation, Quine's animadversions upon second-order logic and in particular his views that second-order logic is 'Set Theory in Sheep's Clothing' are examined. Against Quine's stance I will seek to show that a vindication of second-order logic can be gotten provided a proper due is given to the sharp distinction between the logical notion of set which is the concern of second-order logic and the iterative notion of set which lies within the realm of set theory. In this paper, I argue that limitarian policies are a good means to further political equality. Limitarianism, which is a view coined and defended by Robeyns, is a partial view in distributive justice which claims that under non-ideal circumstances it is morally impermissible to be rich. In a recent paper, Volacu and Dumitru level two arguments against Robeyns’ Democratic Argument for limitarianism. The Democratic Argument states that limitarianism is called for given the undermining influence current inequalities in income and (...) wealth have for the value of democracy and political equality. Volacu and Dumitru’s Incentive Objection holds that limitarianism places an excessive and inefficient burden on the rich in ensuring political equality. The Efficacy Objection holds that even if limitarianism limits excessive wealth it still fails to ensure the preservation of political equality. In this paper, I will argue that both of these objections fail, but on separate grounds. I argue that the Incentive objection fails because one could appeal to limitarian policies that are different from the ones discussed by Volacu and Dumitru and which escape the problem of reduced productivity. I argue against the Efficacy Objection that limitarian policies are a partial but highly valuable step towards establishing political equality, and that they can and should complement or be complemented by other strategies. Christianity proposes that God can be accessed both in the subjectivity of the human self and in the World. This admittedly strange idea can be understood by drawing certain insights from Michel Henry and Dumitru Stăniloae. For Henry, the connection between God and the human self in subjectivity is understood as the generation of the human as a living self in the absolute Life which is God. For Stăniloae, the connection between God and the World is understood through the (...) interpretation of the cosmos as an intelligible medium by which the dialog between God and the human being takes place. These two thinkers have certain lacunae, but their proposals can be fruitfully combined through the supposition that the World is the “body” of God, i.e. His inner life as seen from the outside. Migrant women are often stereotyped. Some scholars associate the feminization of migration with domestic work and criticize the “care drain” as a new form of imperialism that the First World imposes on the Third World. However, migrant women employed as domestic workers in Northern America and Europe represent only 2% of migrant women worldwide and cannot be seen as characterizing the “feminization of migration”. Why are migrant domestic workers overestimated? This paper explores two possible sources of bias. The first is (...) sampling: conclusions about “care drain” are often generalized from small samples of domestic workers. The second stems from the affect heuristic: imagining children left behind by migrant mothers provokes strong feelings of injustice which trump other considerations. The paper argues that neither source of bias is unavoidable and finds evidence of gender stereotypes in the “care drain” construal. (shrink)
